    The Constitution of Kenya grants consumer the right to; goods and services of reasonable quality,
    information necessary for them to gain full benefit from goods and services, protection of their
    health, safety, and economic interests, and compensation for loss or injury arising from defects in goods or services.

    Acquisitions.
    The Competition Act stipulates that a merger, or takeover, may occur when an undertaking directly or
    indirectly acquires control over another business within Kenya. This may happen through, among others,
    purchase/lease of shares, exchange of shares, or vertical integration.
  • Abuse of Buyer
    Power
    Buyer power is the ability of a powerful buyer to obtain terms of supply outside the scope
    of normal business practices or that are disproportionate, unfair and detrimental to a supplier. This
    manifests through, among others, termination of contracts, delayed payments or transfer of risks.
  • Anti-Competitive
    Practices
    The Competition Act outlaws anti-competitive conduct like price fixing, output restriction
    and market allocation. Competitive markets benefit consumers through lower prices,
    increased choice, and enhanced quality of goods and services.

Competition Authority of Kenya

The Authority’s mandate is to enforce the Competition Act CAP 504 (the Act) with the objective of enhancing the welfare of the people of Kenya by promoting and protecting effective competition in markets and preventing misleading market conduct throughout Kenya.

The Authority exercises this mandate by controlling mergers and acquisitions, deterring anti-competitive conduct such as abuse of dominance and price fixing. The Authority also enforces consumers’ rights while sanctioning abuse of buyer power where powerful businesses disenfranchise their weaker suppliers.

The Authority aligns its interventions with the Government’s priorities, while prioritizing our interventions in key sectors such as manufacturing, SMEs, agriculture which have the potential of unlocking significant economic growth and positively impact a large number of Kenyans..
